The NIC Monaco proceeds to the forced transmission (without the agreement of the holder) of domain names in the following cases:

The holder no longer meets the requirements of the Charter concerning this domain name when a new holder who requests it has the capacity to do so (e.g. sale of activity, takeover of a company, etc.);

The holder carries out an asset transaction when the original holder no longer has the capacity to carry out a voluntary transfer;
-
The holder no longer has a legal existence (e.g. cessation of activity) and a new holder has the legitimate rights to obtain this domain name;a court decision ordering the forced transmission of the domain name.

The forced domain name transmission procedure implies that the new holder proceeds, through a Registrar, to all the necessary steps with NIC Monaco and submits to the rules (in particular identification, eligibility) mentioned in the Charter.

In general, the forced transmission can only become effective subject to compliance with the terms of the Charter by - The new owner. The Monaco NIC may, as necessary, carry out the checks it deems necessary and request the communication of the necessary information.

All the costs, in particular technical and administrative costs, related to a forced transmission, are the responsibility of the new holder who, if necessary, takes care of their possible recovery from the former holder.
